A first apartment is not always the determining legal definition
In the search, it is customary to write "first apartment purchase tax", but in calculating the tax, the main question is usually whether the purchased property is classified as a single apartment according to the law. The classification is not determined only by the number of apartments registered in the buyer's name on the day of signing.
Among other things, the family unit, rights of the spouse, partial rights in other apartments, inherited apartments, residences and situations in which one undertakes to sell an existing apartment within the stipulated period are examined. Therefore, checking by the buyer's name alone can be misleading.
How do the purchase tax rates work?
The tax is calculated in layers. Each part of the price of the apartment is charged at the rate corresponding to that level, and not the entire price of the apartment is multiplied by the highest rate that the price reached.
According to the rates in effect at the time the guide was written, in a single apartment of an Israeli resident there is an exemption up to NIS 1,978,745. After that, steps of 3.5%, 5%, 8% and 10% apply to the respective parts of the value. The rates may change, so the binding source is the tax authority on the day of the transaction.

An example of how to calculate
If the price of the apartment is higher than the exemption ceiling, this does not mean that the entire transaction is taxable. First, the exempt part is reduced, and only the balance enters the next steps in order. This results in an effective tax rate that is lower than the highest marginal rate in the calculation.
When only part of the apartment is purchased, the calculation may require a calculation on the full value of the apartment and then an adjustment to the ownership share purchased. This is one of those situations where a quick calculation of the part price alone can produce a wrong result.
